DHS list causing gun purchase denial
hi All! hey, my friend went to buy a gun and was denied. He'd also tried in 2002 and was denied. Last time he'd bought a gun no problem was 1999. He'd had a teenage theft issue expunged around 1980. He is now 55. He hired a lawyer to look into why the expungement is still showing up and preventing his buying a gun.
The lawyer found out that he's not on any FBI list at all, no record of the teenage theft on any police records. What's raising the flag and causing the denial is that he's on the Department of Homeland Security 'list'. It's my understanding there's an appeal process to get off the NIC list - but the process goes thru the FBI which is the overseer of the NIC, right? How does one get off the DHS 'list'?? I've also read that senator Ted Kennedy was once on the DHS list and was removed. I've read that only a handful of people know how to get people removed or added to the DHS list. It's my understanding that the DHS was formed out of the ATF, and then a new Dep't of A,T,F & E was created.... I think this lawyer is going to try the Bradley appeal process - I'm wondering if this will work for the DHS list... Anyone had any experience with this? |

If I were him, I'd try to find a high powered attorney that would work for settlement percentage and sue the shit out of the federal govt. for abrogating my right to self defense.

Lawsuit would be the way to go. There's a reporter on CNN who is on the list and has been trying to get removed from the list for over three years.

Having a FFL 03 (C&R) is very nice as it makes it a snap to buy non C&R firearms in my state. Just show the dealer your FFL 03 or CCW and no need to call BATF for "permission" to make an immediate "off the shelf" purchase.

Buy private at gunshow or get a CCW if you live in a state that allows you to bypass the instant check with a CCW.

nobody knows how to get you off the list ...at least everything I've read/seen shows this to be true...unless you are high powered.
Best way to go is start a lawsuit with the payment being fame for the attorney. |

Wow! Last I heard you had to be a convicted (in a court of law) felon or insane (via psycho board) to be barred from possession of firearms. The homeland security list if merely a monitoring tool to keep tabs on suspicious folk. But being suspicious is not a crime nor a mental illness last I checked.
I think your friend has a lovely lawsuit. |
